General Counsel Services

Effective legal services depend upon a lawyer being able to fully understanding the unique issues facing a particular company and to respond quickly and proactively.  Monthly retainer services allow for a deeper understanding of the businesses’ day to day operations and corporate goals.  

Services include:

  • Fractional General Counsel Services. Call with as many legal questions as you may have, from day-to-day operations to unique, time-sensitive and business-critical issues. Ask about pre-litigation negotiations and strategies relating to disputes with on-going business partners and contract reviews. STEIN will walk you through responding to/avoiding threatened litigation, and identify cost-effective, practical, business-focused solutions.
  • Coordination of counsel/business support services. STEIN will work with current counsel to ensure efficiencies or bring in a preferred network of legal and business support services.
  • External counsel selection and management to determine which lawyers are best for your particular issue. STEIN focuses on quality control, reducing overstaffing and over billing, while increasing the ability to benefit from institutional knowledge across multiple firms.
  • Litigation Valuation/Due Diligence: Review pending litigation of target or portfolio companies in business transactions, including impact on potential mergers/ acquisitions, and offer draft language to address issues that may arise after the deal’s close.

Litigation Services

STEIN analyzes, strategizes and positions clients to reduce/resolve risk of anticipated or ongoing litigation.

  • Litigation Triage: If high stakes or time-sensitive matters are threatened or filed, STEIN will review, analyze and create a road map for the issues being faced -- with no agenda for the case other than winning as that concept is defined by the client, not the attorneys. This includes board presentations.
  • Litigation Valuation/Due Diligence: Review pending litigation of target or portfolio companies in business transactions, including impact on potential mergers/ acquisitions, and offer draft language to address issues that may arise after the deal’s close.
  • Strategic Positioning: Identify and implement proactive strategies to meet your business objective of dismissal, trial or settlement.
  • Litigation Management: Supervise, coordinate and direct current counsel and professionals from the STEIN Quality Services Network, with a focus on quality control, strategic positioning, and reducing overstaffing and over billing.
  • Dispute Resolution Services: Strategize, position and represent you in mediations and/or arbitrations.

Alternate Dispute Resolution Services

STEIN is a trained mediator and arbitrator, having received certificates from the Mediation Skills Training Program at Northwestern University and the PLI Program on Negotiations at Harvard Law School. Stein is on the AAA’s National Panel of Commercial Arbitrators, and was asked to be part of the inaugural panel for Chicago Bar’s Mediation Service Program.

Services include:

  • Neutral Mediator: As a neutral and independent facilitator, assist parties interested in settlement by engaging in creative problem-solving that leads to a negotiated agreement.
  • Neutral Arbitrator: Through written or other agreement of the parties, preside over a private arbitration process as a neutral arbiter of the facts and law resulting in a binding determination of the dispute.
  • Settlement Counsel: Strategize, position and represent a party in settlement discussions that focus on business objectives and early resolution, leaving litigation counsel to focus on the battle of litigating the pending case.
